A landlord was fined £3,100 at Birmingham Magistrates Court for harassing a tenant at his home in Russell Road, Moseley.
Mr Ishfaq Ali Hussain age 44 of Witton Road, Aston, Birmingham was fined £1,000, with £1,000 costs, £1,000 compensation to the tenant and a victim surcharge of £100 after being found guilty of harassing a tenant under Section 1(3A) of the Protection from Eviction Act 1977.
On 30 July 2014 Hussain arrived at the property with a large group of men who brought a large portable speaker into the house and played loud music. They banged on the doors and made threats. Birmingham City Council’s Private Rented Services team received formal complaints, investigated and decided to prosecute Hussain.
Cabinet member for Housing and Homes, Cllr Peter Griffiths, said: “Hussain wanted his tenants out of the property in order to sell it to the council for a local school expansion. Instead of following due legal process as advised by council officers, he decided to try and speed things up by harassing and intimidating a tenant. This is not acceptable and I am glad that we have been able to bring the successful prosecution of this landlord.
“The private rented sector is hugely important to housing in Birmingham and most landlords and tenants have a good relationship. However when relationships break down we are here to support people, ensuring that legal process is followed and that people are treated fairly.”
